PREAMBLE

These General Terms and Conditions of Sale (hereinafter "GTC") govern all sales made by BENJAMIN JEZEQUEL SAS via its website www.benjaminjezequel.com (hereinafter "the Site"). By confirming their order, the buyer acknowledges having read and accepted without reservation all of these GTC.

The products offered for sale are either:

  1. Products currently available in stock.

  2. Products offered for pre-order for a specific period.


ARTICLE 1: REGISTRATION ON THE SITE

To order on the Site, the buyer must create an account by completing the registration form. The buyer guarantees the accuracy and veracity of the information provided and undertakes to update it. The buyer is solely responsible for the confidentiality of their usernames and passwords.

In the event of fraudulent use of their identifiers, the buyer undertakes to immediately inform BENJAMIN JEZEQUEL SAS, which will then take the necessary measures.


ARTICLE 2: ORDER / PRE-ORDER PROCESS

The company reserves the right to refuse any order or pre-order from a buyer with whom there is a dispute.

The steps in the ordering or pre-ordering process are as follows:

  1. Product selection.

  2. Creation of the basket and validation.

  3. Login or create an account.

  4. Delivery address information.

  5. Choice of delivery method.

  6. Validation of the summary.

  7. Acceptance of the T&Cs by ticking the box.

  8. Secure payment.

  9. Receipt of a confirmation email confirming the conclusion of the contract.

  10. Invoice sent upon delivery.

In case of pre-order:

  • The campaign duration and estimated delivery date are indicated.

  • Production begins as soon as the required number of pre-orders are reached.

  • In case of failure, the buyer is fully reimbursed.


ARTICLE 3: PRICE AND METHODS OF PAYMENT

Prices are listed in euros, inclusive of all taxes (TTC), excluding delivery charges. Any variation in VAT or tax creation will be reflected in the final price.

The accepted payment methods are:

  • Bank card (Visa, Mastercard),

  • PayPal.

Payments are secure. Bank details are neither stored nor accessible by BENJAMIN JEZEQUEL SAS.


ARTICLE 4: AVAILABILITY OF PRODUCTS

Products in stock :
Products are offered while stocks last. In the event of unavailability after ordering, the buyer will be informed and will be able to choose:

  • An exchange with price adjustment if necessary,

  • Cancellation of the product concerned with refund.

Pre-order products :
The products are presented in prototype form with descriptions, photos, and even videos. The photos are not contractually binding. The sizes indicated are standard or correspond to average body measurements.


ARTICLE 5: RIGHT OF WITHDRAWAL

In accordance with Articles L.221-18 et seq. of the Consumer Code, the buyer has 14 days to exercise his right of withdrawal, without justification.

The period begins upon receipt of the last product in the order. The buyer notifies their decision to withdraw via a form or any clear statement.

Return of products :

  • To be carried out within 14 days of notification of withdrawal.

  • Unworn, unwashed products, in perfect condition, in their original packaging or equivalent.

  • Return at the buyer's expense.

Refund :

  • Full coverage on products (excluding delivery), except for express option chosen by the customer.

  • Made within 14 days after receipt of the return, by the same means of payment.

No exchanges are offered. Only refunds are available if the conditions are met.


ARTICLE 6: DELIVERY

Areas served : Metropolitan France, Overseas, Europe, North America, Asia, etc.

Delivery methods :

  • Delivery by Colissimo (La Poste), with or without signature depending on the destination.

Time limit :

  • Products in stock: 3 to 6 working days (France), 6 to 10 days internationally.

  • Pre-orders: up to 4 months depending on manufacturing. The exact lead time is specified at the time of ordering.

Costs :

  • Varies depending on weight and destination.

  • Displayed at time of order.

Transfer of risks :
Risks are transferred to the buyer upon delivery of the package. In the event of damaged packages, the buyer may refuse delivery and inform customer service immediately.


ARTICLE 7: RESPONSIBILITY

BENJAMIN JEZEQUEL SAS cannot be held liable for:

  • Any indirect damage,

  • Difficulties accessing the site related to the Internet,

  • Misuse of the Site or Service,

  • Force majeure (war, pandemic, strike, etc.).


ARTICLE 8: LEGAL GUARANTEE OF CONFORMITY

The buyer benefits from the legal guarantee of conformity provided for by articles L.217-4 to L.217-14 of the Consumer Code:

  • Duration: 2 years from delivery.

  • No fees charged to the buyer.

Excluded:

  • Worn, washed, used products,

  • Defects resulting from improper use.


ARTICLE 9: INTELLECTUAL PROPERTY

All elements present on the Site (texts, images, logos, videos, etc.) are the exclusive property of BENJAMIN JEZEQUEL SAS or its partners. Any reproduction, in whole or in part, is strictly prohibited without written authorization.


ARTICLE 10: PERSONAL DATA

Personal data is collected for order processing, delivery, customer management and sending promotional emails (if consent is given).

The buyer has a right of access, rectification and opposition which he can exercise by mail accompanied by proof of identity.

Data may be transmitted to logistics providers or in the event of a legal obligation.


ARTICLE 11: COOKIES

Cookies may be used to improve the user experience, facilitate navigation, and compile traffic statistics via Google Analytics. The user can refuse the storage of cookies by configuring their browser.


ARTICLE 12: EVIDENCE AGREEMENT

The parties acknowledge the validity of electronic evidence. The computerized records of BENJAMIN JEZEQUEL SAS are binding between the parties.


ARTICLE 13: PARTIAL NULLITY

If any clause of these T&Cs is declared invalid, the other clauses shall remain in full force and effect.


ARTICLE 14: MODIFICATION OF THE GTC

BENJAMIN JEZEQUEL SAS reserves the right to modify these General Terms and Conditions at any time. The applicable General Terms and Conditions are those in effect on the date the order is validated.


ARTICLE 15: APPLICABLE LAW AND JURISDICTION

These General Terms and Conditions are subject to French law. Any dispute will be submitted to the exclusive jurisdiction of the Commercial Court of Pontoise.
